Ouagadougou, Nov. 27, 2025 (AIB) - The Council of Ministers this Thursday adopted a draft law bringing profound reforms in the field of labor, with the aim of better protecting workers and regulating certain practices deemed sources of abuse.
The text first provides for a strengthened framework for placement and temporary work activities. With equivalent qualifications, placed or temporary workers must now receive the same remuneration as those in user companies occupying the same position.
Furthermore, the text specifies that employers with direct or indirect interests in a placement or temporary work company will no longer be able to conclude placement contracts with it.
The bill also incorporates consideration of psychological harassment and redefines sexual harassment in the workplace, paving the way for more effective legal action against perpetrators.
To limit abuses related to the succession of precarious contracts, the text restricts the renewal and conclusion of fixed-term contracts (CDDs) with the same worker. It also harmonizes the maximum duration of fixed-term contracts at two years, for both national and non-national workers, ending a discrimination that had previously disadvantaged local workers.
With regard to non-national non-resident workers, the project establishes the obligation to renew every two years the visa relating to the open-ended contract, in order to strengthen the control of the use of foreign expertise.
The text also reclassifies force majeure as a reason for technical unemployment and no longer as an automatic cause for suspension without pay of the employment contract.
It also increases the amount of damages owed to the worker in the event of unfair dismissal, which increases from 18 to 24 months' salary, with the aim of deterring unjustified dismissals.
Finally, the duration of leave for breastfeeding granted to female employees is increased from 14 to 15 months, to harmonize it with that applied to female civil servants.
