Police need more powers to stop ‘naked racism and hatred’ after allowing Sydney neo-Nazi rally, premier says

I don't know how it is in Australia but in Germany it is a constitutional right to hold rallies, so they can't easily stop them from happening (even if they wanted to, which I'm actually not sure they do given how many of our police officers are neo-nazis themselves). Chanting NSDAP and Hitler Youth propaganda during these rallies is still an offence but guess what, they do it anyway.

In NSW (state of Australia), there is no constitutional right to protest, but there is a common law right to peaceful assembly. There is also no inherent right to "freedom of speech" and there are anti-hate laws, but that's another entire story.

However, to hold a rally/protest etc, there is a requirement to submit an application to the Police 7 days ahead. There is a Police planning and financial aspect to this. A large or controversial protest may require more Police. Anyways the Police may choose to approve or deny the application, which basically says "We think this gathering/protest/whatever will be peaceful, and so will not charge people with crimes such as obstruction etc when they walk down the road".So, they can also direct that the protest can march here, but not there, you may gather there, but not here, you may only have this many people in this area, you may only gather during these times etc.

Of course, you are free to ignore these directions, but you may be arrested, or i don't know, maybe strip searched, even if you are a child

Now, don't misunderstand me as defending a Nazi gathering. There has also been a lot of criticism of the Police for "allowing" this protest, including by me. And I still think that the Police should deny any Nazi gathering as being non-peaceful in and of itself. But I can also see the Police perspective of "Two dozen clowns are gathering on this street corner. We don't need to worry about it". Or even let the clowns assemble so they can gather intelligence, identify and keep an eye on them.

For some context: Neo nazi groups have been generating plenty of free publicity and advertising recently, including publicity stunts, creating and attempting to highjack rallies, or cause trouble and subvert rallies that may have had legitimate causes. They will show up at any rally. So, while nobody walks around Australia giving Nazis a second thought, or worry about this on a day to day basis, it is sad and troubling that Nazis get any attention here in Australia (or anywhere) at all.

I asked for a comment from Indiana Jones. Indy knows.

Thanks for the context. Sounds like the Police either fails to see the criminal energy coming from neo-nazis (c'mon....) or they don't really care, don't know which is worse.

I've heard of NSW, I've been there a few times^^
